Terms of Service
Version of October 3, 2026. Effective upon publication.
These Terms constitute a public offer by Garant Exchange. They describe how deals work, how the Service holds and returns crypto assets, and what rights and obligations users and the Service have. Please read them before your first deal.
1. Definitions
- Service means Garant Exchange: the Telegram bot @garant_p2p_exchange_bot, the mini app and the website garantp2p.com.
- User means an individual who has accepted these Terms and uses the Service.
- Offer means a user's proposal to buy or sell a crypto asset at the rate and within the limits specified by that user.
- Deal means an exchange of a crypto asset for national currency between two users under an offer, carried out through the Service.
- Seller means the party to a deal who transfers the crypto asset. Buyer means the party who pays in national currency and receives the crypto asset.
- Crypto assets means the digital assets supported by the Service: USDT on the TRC20, BEP20 and TON networks, as well as BTC.
- Deposit means the crypto asset that the seller has transferred to the Service for the duration of a deal.
- Guarantor (escrow) means the role of the Service: it accepts the deposit for safekeeping and releases it only on the grounds set out in these Terms.
- Balance means the record of a user's crypto assets credited to the Service for paying for deals.
- Moderator means an employee authorized by the Service to resolve disputes.
2. General Provisions
The Service is a P2P platform. Users post offers themselves and agree among themselves on exchanging crypto assets for the national currency of their country. The Service acts as the guarantor of the deal: it holds the seller's crypto asset while the parties perform their obligations and transfers it according to the outcome of the deal.
The Service is not a bank, an exchange office or a broker. It does not buy or sell crypto assets on its own behalf and does not accept payments in national currency: money is transferred directly between users.
By starting to use the Service (launching the bot, opening the mini app, posting an offer or opening a deal), you fully accept these Terms and the Privacy Policy. If you do not agree with them, do not use the Service.
These Terms are published in several languages. All versions have equal force; in the event of any discrepancy in interpretation, the Russian version shall prevail.
3. Who May Use the Service
- You are at least 18 years old and have full legal capacity.
- Exchanging crypto assets is permitted by the laws of the country where you are located, and you are not subject to sanctions.
- You act on your own behalf and in your own interests, not on the instructions of third parties.
- Each person may have only one account. Creating additional accounts to circumvent limits or a block is prohibited.
- You are solely responsible for complying with the laws of your country when dealing in crypto assets, including paying taxes.
4. Account and Account Security
- Your account in the Service is linked to your Telegram account. Sign-in to the mini app is confirmed by a Telegram signature; no separate password is required.
- You can set a PIN code and enable the mini app lock. We recommend doing so if you hold funds on your balance.
- You are responsible for keeping access to your Telegram account and device secure. Never share your PIN code or SMS codes with anyone. Service staff will never ask for them and will never contact you first offering a deal.
- If you suspect that someone else has gained access to your account, report it to support via the bot immediately: we will suspend operations on the account until the circumstances are clarified.
5. Offers
- The rate, amount limits and payment methods are set by the author of the offer. The rate may be fixed or floating, i.e. the official rate plus or minus a markup; a floating rate is updated automatically.
- The author is responsible for the accuracy of the offer. The card for receiving payment must belong to the author personally.
- The Service sets a minimum deal amount for each crypto asset. In an offer, it is converted into national currency at the rate of that offer.
- If the author has not visited the Service for more than 24 hours, their offers are automatically paused.
- Phone numbers, @usernames, links and any other means of contact bypassing the Service must not be included in the name or terms of an offer.
- The Service may hide or delete an offer that violates these Terms.
6. How a Deal Works
- Opening. A user opens a deal under an offer. The amount, rate, fee and payment details are fixed at the moment of opening and do not change thereafter.
- Deposit. Within 30 minutes (90 minutes for BTC), the seller sends to the guarantor's address exactly the amount of the crypto asset specified in the deal, or pays it from their balance. If the deposit is not received on time, the deal is cancelled.
- Payment. After the deposit, the buyer has 30 minutes to transfer the money to the seller's card specified in the deal, attach a photo of the receipt to the deal chat and tap “I've paid”.
- Confirmation. The seller checks that the money has arrived and taps “Money received”. The guarantor then sends the crypto asset to the buyer's address, less the fee.
- Cancellation. Before the deposit, either party may cancel the deal. After the deposit, only the buyer may cancel it, and only before marking the payment as made. If the buyer does not pay on time, the deal is cancelled automatically and the deposit is returned to the seller.
Transfer money only from your own card and only to the card specified in the deal. Do not tap “Money received” until the money has arrived in your account: after that, sending the crypto asset to the buyer cannot be reversed.
7. Custody of Crypto Assets and Return Guarantee
This is the principal obligation of the Service. By accepting a deposit or crediting funds to a balance, the Service accepts the crypto assets for safekeeping and guarantees the following.
- Safekeeping. The Service guarantees the safekeeping of all crypto assets transferred to it, in full, for the entire term of the deal or of their storage on the balance.
- Designated use. Users' crypto assets are used solely to execute deals and withdrawal requests. The Service does not spend them on its own needs, lend, invest or pledge them, or use them for trading.
- Segregated accounting. Each deposit and each balance is recorded separately, linked to the relevant deal and user, and is not commingled in the records with the Service's own funds.
- Release to the buyer. The deposit is released to the buyer after the seller has confirmed receipt of the money, or by a moderator's decision in the buyer's favor.
- Return to the seller. The deposit is returned to the seller if the deal is cancelled, the payment time expires, or a dispute is resolved in the seller's favor. The seller receives it to their own address or to their balance in the Service.
- Withdrawal on request. The balance holder may request the withdrawal of their funds to their own address at any time.
- Time limits. The Service sends crypto assets no later than 24 hours after the grounds for the transfer arise: the seller's confirmation, cancellation of the deal, resolution of a dispute or a withdrawal request. If an additional check is required under the section on anti-fraud measures, this period may be extended to 7 calendar days; the Service notifies the user accordingly.
- Compensation. If crypto assets are lost through the fault of the Service, whether due to a breach of its systems, an error or the actions of its staff, the Service compensates them in full in the same crypto asset.
When the Guarantee Is Limited
- The user specified an incorrect address, network or memo, or sent the wrong crypto asset or the wrong amount to the guarantor's address. The Service will help return such funds, if technically possible, less the network fee.
- The transfer is impossible due to a lawful demand of a government authority or a court decision.
- Blockchain failures and force majeure circumstances. In these cases, the time limits are postponed, but the obligation to return the crypto assets remains in effect.
- The funds are under review due to signs of fraud or money laundering, within the time limits set out in these Terms.
8. Fees
- The fee may consist of a percentage of the transaction amount and a fixed amount in the crypto asset of the transaction. The fixed part covers the blockchain network fee for the transfer made by the guarantor.
- The fee for a completed deal is paid by the buyer: it is deducted from the crypto asset the buyer receives. The seller transfers exactly the amount specified in the deal.
- A fee may also be withheld when the deposit is returned to the seller's address (upon cancellation by the buyer, expiry of the payment time, or resolution of a dispute in the seller's favor) and upon withdrawal from the balance. Returns to the balance in the Service are made without deductions. The fee for a return does not exceed half of the deposit.
- The exact amount of the fee is shown before the transaction is made: before a deal is opened, when entering the withdrawal amount, and in the deal card upon a return. A deal is subject to the fee in effect at the time it is opened.
- Posting offers and cancelling deals before the deposit is free of charge. The network fee for sending the deposit is paid by the sender.
- Fees may change. Changes apply only to new transactions.
9. Disputes
- A dispute may be opened after the buyer has marked the payment as made, for example if the seller does not confirm receipt of the money. While a dispute is in progress, the deposit remains with the guarantor and cannot be transferred to either party.
- The moderator examines the deal chat, receipts and blockchain data and may request additional evidence: a bank statement, a video from the banking app, or identity verification.
- As a rule, the moderator makes a decision within 24 hours of receiving evidence from the parties. By the moderator's decision, the deposit is released to the buyer or returned to the seller.
- Each party has the right to know the grounds for the decision. The moderator's decision is final within the Service but does not deprive the parties of the right to protect their interests in the manner prescribed by law.
- Forged receipts, false disputes and pressure on the moderator result in a block.
10. Limits, Identity Verification and Levels
- As long as either party has few completed deals, the deal amount is capped by the limit for new users.
- Deals above the threshold set by the Service require identity verification. It is carried out by Didit using an identity document and a selfie.
- The paid “Verified trader” badge removes the newcomer limit and moves offers higher in the list.
- Trader levels (Trader, Pro, Merchant) are assigned automatically based on the number of deals, the rating and the share of successful deals.
- Badges and levels reflect a user's history in the Service but do not constitute a guarantee by the Service of that user's honesty. The guarantee for a deal is provided by the deposit held by the guarantor.
11. Balance and Withdrawal
- Crypto assets may be credited to the balance in advance and used to pay for deals; in that case, the deposit is locked immediately when a deal is opened.
- Withdrawals are made upon request to the address specified by the balance holder, within the time limits set out in the section on custody of crypto assets.
- If a withdrawal is delayed due to a check, the amount remains intact on the balance and is sent to the holder once the check is completed.
12. Referral Program
For invited users, a percentage of the amount of their completed deals is credited. The current percentage is shown in the “Invite friends” section. Rewards are withdrawn in USDT, subject to a minimum amount, free of charge. Rewards obtained through one's own or fictitious accounts are cancelled.
13. Anti-Fraud and Anti-Money Laundering
- The Service monitors suspicious activity: forged receipts, payments from third-party cards, series of cancellations and disputes, and links to known fraudulent addresses.
- If there are signs of fraud or money laundering, the Service may suspend a deal or withdrawal and request identity verification and information on the source of funds.
- Suspended funds are neither written off nor confiscated: they are held by the guarantor until the check is completed and are then transferred to the person entitled to them according to the outcome of the deal, unless otherwise required by a lawful demand of a government authority or a court decision.
14. Prohibited Activities
- Fraud, forged receipts, and reversing a payment after a deal has been completed.
- Paying from or to third-party cards, and acting as an intermediary on behalf of third parties.
- Transactions with criminally obtained funds, money laundering, terrorist financing, and sanctions evasion.
- Moving a deal outside the Service after meeting through it.
- Insults, threats, spam, automated actions without the Service's permission, and hacking attempts.
15. User Rights
Every user has the right to:
- know all terms of a deal, including the rate, amount, fee and payment details, before opening it;
- the safekeeping of their crypto assets and their transfer or return on the grounds and within the time limits set out in these Terms;
- request the withdrawal of funds from their balance at any time;
- open a dispute and submit evidence, receive a decision and learn the grounds for it;
- receive notifications about every step of a deal;
- contact support with a question or complaint and receive a response;
- obtain a copy of their data, correct it or delete their account in accordance with the Privacy Policy;
- be informed in advance of material changes to these Terms;
- stop using the Service at any time, after first withdrawing the funds from their balance.
16. User Obligations
- Provide only accurate information about yourself and your payment details.
- Pay only from your own card and only to the card specified in the deal, and complete the steps of the deal on time.
- Tap “Money received” only after the money has actually arrived.
- Keep receipts and correspondence until the deal is completed and any dispute is resolved.
- Comply with these Terms and the laws of your country.
17. Rights and Obligations of the Service
The Service undertakes to:
- hold users' crypto assets and transfer them in accordance with the section on custody;
- display all terms and fees before a transaction is made;
- resolve disputes impartially;
- protect users' data in accordance with the Privacy Policy;
- respond to users' inquiries.
The Service has the right to:
- change fees, limits and the minimum deal amount for new transactions;
- request identity verification and additional evidence;
- suspend transactions and block accounts in the event of violations of these Terms, while preserving the user's funds in accordance with the section on anti-fraud measures;
- carry out maintenance, giving advance notice whenever possible.
18. Liability
- The Service is liable for the safekeeping and timely transfer of crypto assets accepted for custody, within the scope of the section on custody of crypto assets.
- The Service is not liable for the actions of banks and payment systems, delays and failures in blockchain networks, user errors in addresses and payment details, exchange rate fluctuations or the actions of third parties, nor for lost profits.
- The user is responsible for the accuracy of their data and shall compensate for any damage caused to the Service or other users by violating these Terms.
- Technical interruptions are possible. Open deals and funds on the balance are not lost in such cases, and deal time limits are extended where necessary.
19. Blocking and Termination of Use
- If an account is blocked, its open deals are completed or reviewed by a moderator. Funds on the balance are returned to the holder at the address they specify once the check is completed, unless otherwise required by a lawful demand or a court decision.
- You may stop using the Service at any time. Before doing so, withdraw the funds from your balance; when you request account deletion, we will remind you of any remaining balance.
20. Changes to These Terms
A new version is published on this page with its date. The Service notifies users via the bot of material changes concerning fees, time limits or custody of funds at least 7 days before they take effect. Changes do not apply to deals opened before that date. By continuing to use the Service after the changes, you agree to the new version.
21. Dispute Resolution
First, contact support via the bot: we review claims and respond within 10 calendar days. If the disagreement cannot be settled, the parties may protect their interests in the manner established by applicable law.
